TSC won’t and can’t obey Kenyan court orders

January 2015, African presidents met in Addis Ababa for the African Union Heads of State Summit  and supported the idea of forming an African Court of Justice and Human Rights to replace International Criminal Court (ICC).  President Uhuru kenyatta according to press reports said that  he will contribute KSh. 90 million towards the formation of the African court.

We have our own courts which the government does not respect at all. It thrashes most of the rulings that our own courts make. Then what is the need of wasting a lot of money to form an African court if we do not respect our own courts?

Teachers Service Commission (TSC) a government entity has defied court orders several times and it has gone unpunished. The latest  being defying a court order by not remitting the September pay of teachers.  The  September 25th court order read quote unquote “In the interests of the children in public schools and their rights under the Constitution, the court directs the unions to suspend for 90 days… no victimisation in any way or any adverse step be taken against the teachers for participating in the strike, which was declared protected and legal. You were directed thus to pay full salaries and allowances to the teacher.” No action has been taken against TSC for defying his court order.

Teachers complied with the court orders and went back to class. Why should anybody want to victimize them by not paying their September salaries?  Why is TSC not ready for constructive negotiations?
According to standard, Wilson Sossion indicated that president Uhuru Kenyatta  is behind the recruitment of relief teachers as existing  teachers go  unpaid. I know the president’s fans will not  agree with anything that talks negative about him. But Kenyayote being not a political blog we don’t play politics. We feed you with facts.The president is in charge of this country and he is supposed to hear and respond to the cries of all Kenyans more-so citizens like teachers who are law abiding.  He has failed to do so.

The move by president Uhuru Kenyatta to travel to ICC to attend a court proceeding is a clear indication that African presidents only respect international courts. Therefore KNUT should think of taking the government to the ICC for violating the rights of teachers. ICC is the only court they respect and fear.
